ICAI Removes Names of Chartered Accountants For Professional Misconduct

No. PR/303/13-DD/293/13-DC/510/2016.—In terms of the provisions of Section 21B(3) of the Chartered Accountants Act, 1949 read with Rules 18(17) and 19(1) of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, the Disciplinary Committee has held CA. Raj Seckhar M S (Membership No. 200772), Macheri Manor 2, S R Layout, Near All India Radio, Coimbatore, guilty of Professional Misconduct falling within the meaning of Clause (7) of Part I of Second Schedule to the aforesaid Act and consequently vide its order dated 10th December, 2019 ordered for removal of the name of aforesaid CA. Raj Seckhar M S (Membership No. 200772), from the Register of Members for a period of 01(One) month. In pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section
(2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations, 1988, the name of said CA. Raj Seckhar M S (Membership No. 200772) was removed from the Register of Members for a period of 1(One) month with effect from 25th September, 2020. Subsequently the Respondent approached the Appellate Authority in terms of Section 22G of the Chartered Accountants Act, 1949 and the Appellate Authority vide its interim order dated 30th September, 2020 had ordered that the name of the Respondent be restored. Accordingly, in pursuance of the said interim order of the Appellate Authority, name of the Respondent was restored w.e.f 30th September, 2020 i.e. the date of the order of the Appellate Authority. Thereafter, the Appellate Authority vide its final order dated 12th January, 2022 in Appeal no. 16/ICAI/2020 has set aside the impugned Order of the Disciplinary Committee and held the Respondent Not Guilty of any misconduct. Accordingly, the notification dated 25th September, 2020 wherein the name of CA. Raj Seckhar M S (Membership No. 200772) was removed from the Register of Members stands withdrawn.

No. PPR/P/382/17/DD/03/ INF/18/DC/1353/2020.—In terms of the provisions of Section 21B(3) of the Chartered Accountants Act, 1949 read with Rules 18(17) and 19(1) of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, the Disciplinary Committee has held CA. Muthukumaran Jayaraman (Membership No. 207004), 52 A V M Avenue, First Main Road, Virugambakkam, CHENNAI 600 092, guilty of Professional Misconduct falling within the meaning of Item (7) of Part I of Second Schedule to the aforesaid Act and consequently ordered for removal of name of CA. Muthukumaran Jayaraman (Membership No. 207004) from the Register of Members for a period of 01(One) year and also imposed a fine of Rs. 1,00,000/-(Rupees One Lakh) only to be paid within 3 (three) months and in case of default in payment of fine within stipulated time, his name be removed for additional 1(one) month period. Since the Respondent had failed to pay the imposed fine within stipulated time, in pursuance of the aforesaid Order of the Disciplinary Committee and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations 1988, it is hereby notified that the name of said CA. Muthukumaran Jayaraman (Membership No. 207004), shall stand removed from the Register of Members for a consolidated period of 13(Thirteen) months [01(one) year plus additional 1(one) month] with effect from 14th February, 2022.
