Trademark Objections and Responding to Examination Reports (MIS-R)
Trademark Objections and Responding to Examination Reports

If you’re looking for trademark registration to register your brand or product, you might come across  a situation where your application gets an objection and it happens when the trademark department has some concern about your application. But don’t worry! You can respond to these objections by filing a reply to the examination report within 1 month either through efiling mode or by mailing them to parm.tmr@nic.in

It is important to note that one can also apply for direct hearing instead of filing reply to the examination report but it is suggested not to jump the process and in any case if the department does not accept your application based on the MIS-R, they will cause it for Ready for Show Cause Hearing.

What are Trademark Objections?

Trademark objections are generally red flags raised by the trademark registry regarding your trademark application. There can be various reasons for objections, such as similarity to existing trademarks, lack of distinctiveness, or improper classification of goods and services covered by section 9/11 or under both. These objections are outlined in an “examination report” sent to you by the trademark department.

If you have received the trademark objection, you will also find an alert on the trademark registry website as “Awaiting Reply to Examination Report”.

How to Respond to an Examination Report:

1. Understand the Objections:

Read the examination report carefully to understand the specific objections raised by the trademark department . This will help you address each concern properly.

2. Evidence and Information:

Collect evidence or information that supports your trademark’s distinctiveness or differences from existing trademarks. This might include sales figures, customer testimonials, or any USP (unique selling point) of your product or service.

3.Draft Your Response:

Draft a well-structured reply addressing each objection separately. Be clear and concise in explaining why your trademark deserves registration despite the objections.

4. Make Necessary Changes:

If the objections relate to specific details, consider modifying your trademark application as per the requirements outlined in the examination report(MIS-M).

5. Seek Professional Help:

Consider consulting a trademark attorney or professional experienced in handling trademark objections. They can provide valuable guidance and ensure your response is comprehensive and effective.

6. File Your Reply:

Submit your reply to an examination report along with any supporting documents or modifications to the trademark department within the specified timeframe i.e one month.  Ensure to follow the guidelines provided.

Conclusion:

Responding to a trademark objection requires attention to detail and a clear explanation of why your trademark deserves registration. It’s essential to address each objection carefully which has been mentioned in the examination report and provide evidence or arguments to support your case.

Remember, receiving an objection doesn’t mean the end of your trademark application. With the right approach, you can increase the chances of overcoming objections and successfully registering your trademark.
