In a significant development, the Learned Counsel representing the appellant, M/s. C & C Constructions Ltd, informed the court that the appellant’s company is currently undergoing a liquidation process. The National Company Law Tribunal (NCLT), in its order dated 7th October 2022, had appointed the Official Liquidator to oversee the proceedings.

Considering these circumstances, the appellant expressed their intention to withdraw the appeal in the case against the Commissioner of Customs (Port), Kolkata. Subsequently, the court has dismissed the appeal as withdrawn.

The case, identified as Customs Appeal No. 75068 of 2016, was presided over by Hon’ble Mr. R. Muralidhar, Member (Judicial), and Hon’ble Mr. Rajeev Tandon, Member (Technical).
