Delhi High Court Designates Special CBI Court to Expedite Trial of India’s Biggest Bank Fraud
The Delhi High Court has taken a significant step towards expediting the trial of India’s largest bank fraud by designating a special Central Bureau of Investigation (CBI) Court for this purpose. The case involves the alleged loan fraud of Rs 34,614 crore and centers around the promoters of Dewan Housing Finance Ltd (DHFL), Dheeraj Wadhawan and Kapil Wadhawan, along with several other individuals.
This decision comes in response to the enormity of the case, characterized by a substantial volume of documents filed by the CBI, a large number of accused persons, and the involvement of hundreds of witnesses. Special CBI Judge Ashwani Kumar Sarpal emphasized the necessity of expediting the trial due to these factors, as well as the infeasibility of concluding the trial within a reasonable timeframe in a regular court dealing with other matters.
In a compelling statement, the special CBI Judge underscored the need for a designated court to exclusively handle this complex case on a day-to-day basis. The High Court’s order to designate the special CBI Court further reinforces the gravity and complexity of this high-stakes legal proceeding.
The detailed judicial order from April 27 revealed staggering statistics, including over 330,000 pages of documents filed by the CBI and a total of 108 accused persons/entities, each to be represented by different counsels. Additionally, the court is expected to contend with approximately 736 witnesses, further contributing to the intricacy of the case.
