Gauhati High Court Suspends Verdict in APSC ADO Cash-for-Jobs Scam

In a significant development, the Gauhati High Court has suspended the verdict of the Court of Special Judge, Assam, in the high-profile Assam Public Service Commission (APSC) Agricultural Development Officer (ADO) cash-for-jobs scam. Furthermore, the court has granted bail to 26 of the accused, providing them with temporary relief from the severe penalties.

The High Court’s decision comes in the wake of the July 29 sentencing by the Court of Special Judge, which saw former APSC chairman Rakesh Paul being sentenced to 14 years of imprisonment and fined Rs. 2 lakh. Additionally, two other former APSC members received 10-year jail terms, while 29 candidates implicated in the scandal were each sentenced to four years in prison and fined Rs. 10,000.

The ADO cash-for-jobs scam, which first came to light in 2015-16, uncovered pervasive corruption within the APSC, particularly in relation to irregularities during the selection process for ADO positions advertised in 2013. The case began to unfold following a complaint lodged at Bhangagarh Police Station in Guwahati in 2017 by a candidate who alleged being asked for a bribe of Rs. 15 lakh. This complaint triggered a series of revelations, leading to the identification of a total of 44 accused, including former APSC members, ADOs, and middlemen.

The Special Judge’s Court had convicted the accused under various sections of the Prevention of Corruption Act and the Indian Penal Code (IPC), including charges of cheating, forgery, and criminal conspiracy. The suspension of the verdict and the subsequent bail granted by the High Court mark a significant turn in this high-profile case, which has drawn widespread attention due to its implications for the practice of corruption in recruitment processes.
