Supreme Court Orders Restitution of Flats in DSK Group Case

The Supreme Court of India ordered the restitution of 14 residential flats, valued at approximately Rs. 70 Crore, to the Successful Resolution Applicant in a case involving M/s. DSK Southern Projects Pvt. Ltd. This follows investigations by the ED into fraudulent activities, with proceeds of crime estimated at Rs. 1,129 Crore.

Supreme Court Orders Restitution of Flats in DSK Group Case

The Supreme Court of India vide order dated 16.07.2026 ordered to restitute the attached 14 residential flats, to the Successful Resolution Applicant in a case against M/s. DSK Southern Projects Pvt. Ltd. and others. The market value of these flats is approximately Rs. 70 Crore. The restitution of the Flats to the rightful claimant marks a significant step in the ED’s ongoing efforts to ensure that the POC are returned to those affected.

ED Restitutes 14 Residential Flats DSK Group Case

Directorate of Enforcement (ED), Mumbai Zonal Office, has restituted 14 residential flats, in a PMLA case against M/s. DSK Southern Projects Pvt. Ltd., and others to the Successful Resolution Applicant. The market value of these flats is approximately Rs. 70 Crore.

The restitution, is consequent to the order dated 16.07.2026 passed by Hon’ble Supreme Court of India under the second proviso to Section 8(8) of the Prevention of Money Laundering Act, 2002 (PMLA). Possession of the 14 flats situated at “Mantri DSK Pinnacle”, Hulimavu Village, Begur Hobli, Bengaluru, was handed over by ED on 14.08.2026.

The ED investigation arose from FIRs registered by the Economic Offences Wing (EOW), Pune, against Deepak Sakharam Kulkarni and others of the DSK Group. Investigation under the PMLA revealed diversion and layering of funds mobilised from investors through fraudulent deposit schemes, with proceeds of crime assessed at approximately Rs. 1,129 Crore.

During investigation, ED provisionally attached assets valued at approximately Rs. 904 Crore vide PAO dated 14.02.2019. The attachment was subsequently confirmed by the Adjudicating Authority under the PMLA, and a Prosecution Complaint was filed before the Hon’ble Special Court (PMLA), Mumbai, which took cognizance.
