NCLAT defers hearing on Amazon’s appeal against CCI’s order till February 25

The National Company Law Appellate Tribunal (NCLAT) on Monday deferred the hearing of e-commerce giant Amazon’s plea till February 25.

The e-commerce sector company has urged for an interim stay on the order passed by the Competition Commission of India (CCI). CCI has acquired Amazon’s Future Coupons Pvt Ltd. (FCPL) has suspended approval for a nearly two-year-old deal.

The NCLAT bench said it was not possible to hear the matter on Monday as a member of the bench was retiring after four days of completing his term.

The bench said that before passing an order in this matter, other parties like the CCI will also be given an opportunity to make their point. It will take some time and the retiring members will no longer be part of the bench.

In such a situation, the NCLAT, deferring the hearing of this matter, directed to list Amazon’s petition on February 25. During the hearing, senior advocate Gopal Subramaniam, appearing for Amazon, sought a stay on the order of the CCI. He said that 60 days time for implementation of CCI order is going to be completed this week.

To this, the bench said that the original order in this regard was passed on December 16 and it may hear the matter next week.
