Relief for Salaried Individuals as TCS Rules Offered Small Respite

The recent proposals regarding Tax Collection at Source (TCS) have sparked concern among individuals, but there is now a glimmer of relief, particularly for those with salary income.

Presently, salaried employees have the option to declare additional income, such as bank interest and rent, to their employers. Subsequently, the employer adjusts the tax deductions against the monthly salary to accommodate this additional income. This process alleviates the need for the employee to worry about paying advance tax, as the required tax has already been withheld. Effective from October 1, a similar practice will come into play with regards to TCS. Salaried employees will be able to declare TCS, which the employer will then factor in, resulting in a reduced Tax Deducted at Source (TDS) against the salary income. This adjustment aims to alleviate cash-flow concerns. Moreover, if a refund was anticipated due to TCS, the individual taxpayer will no longer face the inconvenience of waiting for it, as it will be adjusted against TDS on the salary income.

It’s important to note that TCS applies to a broad spectrum of remittances made under the Liberalised Remittance Scheme (LRS) of the Reserve Bank of India. This scheme allows individuals to remit up to $2.5 lakh per year without seeking prior approval. Previously, expenses such as purchasing an overseas tour package incurred significant TCS, with a 5% TCS for a remittance of up to Rs 7 lakh, and 20% for higher amounts. Similarly, sending a child overseas also triggered TCS deductions at 5% for any remittance above Rs 7 lakh, with a lower rate for remittances via education loans.

In summary, the recent Budget has introduced a welcome alteration to the TCS provisions for salaried individuals, aiming to alleviate some of the financial burden they may face.

This adjustment in TCS rules is poised to ease the taxation process for salaried individuals, potentially resulting in improved cash flow and reduced inconvenience when dealing with TCS-related refunds.
