NO NEW ANTI-PROFITEERING INVESTIGATIONS UNDER GST

The news that the government plans to discontinue anti-profiteering investigations under the Goods and Services Tax (GST) from April 1, 2025, has generated mixed reactions. While some see this as a positive move to reduce compliance burdens on businesses, others express concerns about the potential impact on consumer protection.

From April 1, 2025, new anti-profiteering investigations under GST will cease, allowing businesses to set prices independently. Ongoing cases will continue, with the GST Appellate Tribunal taking over from the Competition Commission of India starting October 1, 2024.

However, ongoing complaints and investigations will continue until they reach a final conclusion.

Understanding Anti-Profiteering Measures

Anti-profiteering measures were introduced under the GST regime to ensure that businesses pass on the benefits of reduced tax rates to consumers. These measures allowed authorities to investigate instances where businesses were not reducing their prices commensurately with the reduction in input tax credit or GST rates.

The government will need to carefully balance the need to reduce compliance burdens on businesses with the imperative to protect consumer interests. It may consider alternative mechanisms to monitor pricing practices and ensure fair competition in the market.
