GST Council Meeting: Significant Exemption for Life and Health Insurance?

The 56th GST Council is set to convene on September 3-4, with a highly anticipated proposal that could benefit the citizens of India through a complete exemption of GST on life and health insurance.

Sources have indicated that the Members of the Group of Ministers (GoM) on health and life insurance have reached an in-principle agreement, emphasizing the need to reduce the burden of Goods and Services Tax (GST) on life and health insurance. This proposal will be presented as part of the GoM’s report during the forthcoming GST Council meeting.

Interestingly, the GoM has shown broad support for the Union government’s proposal to exempt all individual life insurance and health insurance policies from GST. However, several states, including Karnataka, West Bengal, Kerala, Punjab, and Tamil Nadu, have raised concerns. They argue that the exemption should only be effective if insurers are required to pass on the benefits directly to policyholders.

These states have expressed worries that, without proper regulation, insurance companies might retain the tax benefits for themselves, leading to unchanged premiums for policyholders. This situation has become a point of contention, particularly as the insurance regulator, IRDAI, has not provided clear guidelines on this matter. Members of the GoM repeatedly underscored that the ultimate beneficiaries of any GST exemption should be the policyholders, rather than the insurance companies. They have also discussed measures to ensure that the advantages of a complete exemption are effectively transmitted to customers.

According to estimations, the financial impact of the Union government’s proposal would be approximately ₹9,900 crore annually. The proposal is intended to include two key points:

  1. Granting GST exemption to all individual life insurance policies, including reinsurance.
  2. Granting GST exemption to all individual and family floater health insurance policies, along with reinsurance.

Ultimately, the final decision regarding this proposal will lie with the GST Council, which is expected to deliberate on it during their upcoming meeting.
